The Santa Clara County DEH serves as the Local Enforcement Agency (LEA) for medical waste management within the county. The DEH Medical Waste Management Program ensures the protection of public health, safety, and the environment through the implementation and enforcement of regulations governing the handling, storage, treatment, and disposal of biohazardous waste. All healthcare facilities in San Jose that generate medical waste — including hospitals, clinics, dental offices, veterinary practices, laboratories, and long-term care facilities — must register with or obtain a permit from the County DEH.

Key Regulations for San Jose Medical Waste Generators

Biohazardous Waste (Red Bag Waste):

• Must be placed in red biohazard bags (no more than 3 pounds per bag) and tied securely to prevent leakage

• Bags must be placed inside an approved, lined biohazard container labeled "BIOHAZARD"

• Storage is limited to 7 days if generating more than 20 pounds per month, or 30 days if generating less than 20 pounds per month

• Waste stored at or below 32°F (in a freezer) may be stored for up to 90 days

Sharps Waste:

• Must be placed in a rigid, puncture-proof sharps container that is sealable and labeled "Sharps Waste" or with the word and symbol "BIOHAZARD"

• Containers must not be filled past the three-quarter full mark

• Once sealed, sharps containers can be placed inside your biohazard bin for collection

Pathological Waste:

• Must be segregated from biohazardous waste

• Containers must be labeled "Pathology Waste"

• In California, pathological waste is typically treated by incineration

Pharmaceutical Waste:

• Non-hazardous pharmaceutical waste must go into a container labeled "INCINERATION ONLY"

• Containers must be secured to prevent unauthorized access

• May be stored on-site for up to 90 days from the date the container is ready for disposal

• Hazardous pharmaceuticals (P-listed and U-listed drugs) are regulated under RCRA and require separate handling

Accumulation Area Requirements:

• All medical waste must be stored in a designated accumulation area that is secured against unauthorized access

• The area must display a biohazard warning sign legible from at least 25 feet, written in both English and Spanish

• The accumulation area must be separate from patient care areas and general waste storage
